Court issues Opinion and order denying United States’ Motion to Dismiss. The Court’s Opinion holds that the Bureau of Reclamation cannot “use decades of inaction, inconstancy and failures to deliver on its statutory duty and court-ordered responsibilities as an end-run around the statute of limitations regarding plaintiffs’ claim . . . . Fairness directs giving plaintiffs the opportunity to present evidence to the court on whether or not a taking has occurred based on defendant’s failure to provide a drainage solution for the Westlands for over fifty years.” (Revised final opinion filed on January 15, 2014)
